Three rules run at once when your brand name lands on the same metal as a fineness stamp: a federal marking statute, the FTC’s reading of it, and production reality.
Rule 1: a quality mark needs a trademark or a responsible name
The National Gold and Silver Stamping Act is the statute the FTC cites when it explains what must accompany a quality mark such as 925. 15 U.S.C. § 297(b) requires whoever applies the quality mark to “apply or cause to be applied to that article a trademark of such persons … or the name of such person”. The same subsection adds that each identifying trademark or name “shall be applied … by the same means as that used in applying the quality mark or stamp appearing thereon, in type or lettering at least as large as that used in such quality mark or stamp, and in a position as close as possible to that quality mark or stamp”. Four decisions, made before the laser is programmed: same method, lettering at least as large, position as close as possible, and content naming a responsible party.
Rule 2: the FTC guides define what a quality mark is
The FTC Jewelry Guides at 16 CFR Part 23 carry the same idea. Section 23.10 defines a quality mark broadly – any letter, figure, numeral, symbol, sign, word or term indicating precious metal content – and the note to that section records the Stamping Act rule that whoever applies a quality mark also applies the trademark or name of that person. The consequence for a private-label run: a brand name alone is an identifier, which is the point. A lockup reading “YOURBRAND 925”, or carrying the word sterling, is a quality mark – and that fineness then has to be true of every piece in the carton, not just the reference sample.
Rule 3: a fineness claim the metal cannot support
The companion prohibition is 15 U.S.C. § 294: it is unlawful to import or transport gold or silver ware marked to indicate a greater fineness than it has. The third mark nobody schedules: the assay office
If the same SKU also ships to the UK or EU, an assay office applies the compulsory sponsor, fineness and assay office marks – it applies them, not you. The inner band then carries your brand, the fineness statement and, on UK-bound pieces, the assay marks. Mark before final polishing and the wheel can round the edges of the characters. Mark after polishing and the piece needs another clean before packing. On plain S925 that is a scheduling detail; on gold vermeil it is a specification. Our published vermeil build is at least 2.5 microns of 18K gold over recycled 925 silver, so a mark cut after plating opens the gold layer inside the letterforms and lets the silver beneath show as contrast under a loupe. Cutting before the plating tank avoids that, but the marking station then feeds the plating line – a queue change, not a depth setting.

What actually drives the per-piece number
- One-time NRE: mark file, fixture and first-article approval on your actual blank – paid once per layout, not per piece.
- Cycle time per piece: load, align, mark, unload, inspect. Laser-on time is the small part.
- Inspection coverage: AQL 2.5 lot sampling or a 100% legibility check on a brand-critical mark.
- Recovery cost: a mis-marked ring cannot be un-etched; re-polishing removes the mark and some surface, and the finishing labour is lost.

Can the brand name be etched on top of the existing 925 stamp?
No, and no factory should offer it. Marking across the fineness digits fills them with displaced metal and destroys the mark the exercise exists to support. The compliant pattern is a separate mark as close to the fineness stamp as the surface allows.
Does the brand name have to be a registered trademark?
The statute anticipates a trademark registered or applied for within the statutory window, or the name of the responsible person, so a business name is a workable identifier. Treat the call as one for your own counsel; the factory needs the exact wording and artwork before the mark file is locked.
Is laser etching the same thing as hallmarking?
No. Hallmarking is a statutory assay and marking regime; in the UK the compulsory marks are applied by an assay office, not a manufacturer. Laser etching simply applies your own identifier to the article.
Will etching weaken the ring or start a corrosion point?
Laser marking is a shallow surface treatment rather than a structural cut, positioned away from thin sections, solder joints and stone seats. Tarnish is a finish question: an etched mark sits outside the anti-tarnish layer, so agree the finish sequence first.
